SUBJECT OF THESE TERMS OF USE
The website www.chapverse.com is a website for the exchange of stories. These Terms of Use apply to any use of stories by the user.
USE
Unregistered users
Unregistered users can read stories.
Registered users
In order to use the other features of Chapverse, the user must log in and accept these Terms of Use and the Privacy Policy. To register, the user must complete the registration form. The application is an offer to Chapverse to enter into a contract of use of stories ("User Agreement") in accordance with these Terms of Use. Chapverse is free to accept or decline this offer. The user agreement is created when Chapverse unlocks the user's access. There is no entitlement to the access against Chapverse. The user must provide a valid e-mail address when registering. The user is obliged to notify Chapverse immediately of any changes to his e-mail address. Chapverse will use the email address of the user deposited in the login data for all declarations to the user in connection with the use of Chapverse. The user must choose a pseudonym when registering. Only such pseudonyms are allowed that do not violate applicable law or morality. Para. 6 applies accordingly. The pseudonym also serves as the author name of the user.
AUTHOR ACCOUNTS, PASSWORDS AND PASSWORD SECURITY
The user must choose a password when logging in. The secrecy, retention and non-disclosure of this password to third parties is the responsibility of the user. If the user has the suspicion that his password has become known to a third party or that a third party is using the user's access without authorization, he is obliged to inform Chapverse immediately in writing.
DATA PROTECTION
Chapverse operates in accordance with the provisions of data protection and the privacy policy.
RESPONSIBILITY OF AUTHORS
All content provided by users on Chapverse is the sole and complete responsibility of the user who posted it on the site. Chapverse does not control this content, nor does Chapverse check its quality.
DOS AND DON'TS
The use of Chapverse is only permitted within the intended scope of functions. The user may not use any software or other technical devices that change, expand or endanger the functioning of the website. The user may not change or overwrite the contents and figures of the website. The user may not upload any files or executable content on the website. The posting of content is only allowed under the user's own pseudonym. The usage of a foreign identity is inadmissible. The use of Chapverse for commercial purposes is prohibited. This is especially true for Contractual statements of any kind and the promotion of content, services or products for consideration; the promotion or performance of contests, raffles, barter deals and contract offers; the electronic or manual collection of data of other users. The user warrants that all content posted by her or him on the website complies with applicable law and morality. The upload of contents that are discriminatory, racist, violent or inhumane, call for criminal acts or endorse them, include pornography or violate the youth protection laws or violate personal rights of third parties is inadmissible. The user may not link to pages that acc. Para. 6.F contain inadmissible content or refer to such content. The user may not place any links without content related to Chapverse for the purpose of increasing the page rank of the linked page (link spam). The user warrants that she or he is entitled to all necessary rights to the content she or he posts on the website. Users are obliged to treat each other in a respectful and fair manner. A polite tone has to be maintained. Entries solely for the purpose of provoking or insulting other users or third parties are inadmissible. The user releases Chapverse from all claims of other users and third parties and replaces Chapverse for all damages and expenses incurred by Chapverse for breach of the obligations under this clause. 6 arise, unless the user proves that he is not responsible for the violation. Chapverse reserves the right to reject, block or delete the user's content without giving reasons. The user himself ensures adequate protection of the content he has posted. RIGHTS TO CONTENT, CHANGES TO CONTENT
By posting content on the website, the user grants Chapverse the free, temporally unlimited, according to these terms of use, otherwise unlimited time to publish this content on the website, in particular to store this content on a server of Chapverse or on behalf of Chapverse at a third party. to publish the contents on the internet. to edit and duplicate the contents as far as this is necessary for the operation of the website. This right of use remains even after termination of the contract of use. Chapverse expressly advises the user that it is not possible to delete published content, as it would affect the entire story that other users have been involved with. In justified exceptions, content can still be deleted. To do this, the user must contact Chapverse by email (info@chapverse.com). The user is aware that Chapverse can not prevent other users or third parties from copying, distributing or making publicly available the content of the user. The user acknowledges that the uploading and the generally associated publication of his material takes place within certain parameters specified by the Chapverse.de technology. This can lead to existing formats and content being changed. Furthermore, there is a possibility that changes may occur in the development of the technique used by Chapverse. Each user is required to check and, if necessary, modify the content he has posted after uploading and from time to time. If a user of Chapverse believes that his intellectual property has been copied or plagiarized by another unauthorized user, he is requested to notify Chapverse in writing. This message should contain the following information: Pseudonym and e-mail address of the user who sees his rights violated; Information about the author who caused the infringement, ie. its pseudonym, and, if known, its e-mail address; Information about the content for which the rights were violated, namely the category in which they were posted, the titles and the upload data; Information on the unlawful content, including the category in which they were posted, the titles and the upload information; possible further information to prove the infringement;
AVAILABILITY
Chapverse makes the website available as far as the technical and operational possibilities allow. Chapverse makes every effort to ensure uninterrupted usability. However, technical faults, temporary restrictions or interruptions may occur. Chapverse can change the website and its features at any time or disable individual functions. The User Agreement does not constitute a legal claim of the User against Chapverse to provide certain functions or uses.
DELETION AND LOCKING OF USER ACCOUNTS
Chapverse may suspend User's access temporarily if third parties claim and convict violations in connection with the use of Chapverse, or if there are other legitimate doubts as to the lawfulness of the use of the Services. The termination rights according to para. 11 remain untouched.
DAMAGE AND EXPENSES REPLACEMENT
Chapverse will indemnify and reimburse useless expenses, for whatever legal reason, only for intent and gross negligence.
TERMINATION OF THE USAGE AGREEMENT
The user and Chapverse can each terminate the user agreement at any time without observing a notice period. In case of termination, the user has to cease the further use of Chapverse immediately.
TRANSFER TO THIRD PARTIES, MODIFICATION OF THE AGREEMENT OF USE
Chapverse may change the User Agreement and transfer it to a third party without the user's consent. Chapverse will announce such change or transfer in writing four weeks in advance. The user's consent is considered granted if the user does not object in writing within a period of two weeks after receipt of the announcement. Chapverse will separately inform the user in the announcement of this period and the consequences of their failure.
ENDING
Insofar as declarations have to be made in writing in accordance with these terms of use, e-mails are also sufficient. Statements by the user must be sent to the following address:
